The UK’s exit from the European Union has left many parents with the issue of choosing a place of residence. In the event that one parent decides to return to the country and the other to remain in the UK, the problem arises as to the child’s place of residence, with which parent they should remain and which court has jurisdiction to hear child custody cases. Council of Europe Regulation 2019/111 ceased to apply after the UK left the EU, and the issue of changing the child’s habitual residence is regulated by the Hague Convention on Cooperation in the Area of Parental Responsibility.
Paragraph 4.5 of the Practical Handbook to the 1996 Convention – “The concept of habitual residence” indicates, as a common basic factor connecting the modern Hague Convention on children. It is not defined in the Convention, but must be determined by the relevant authorities in each case based on factual elements.”
